What is a Family Trust?
Under English common law, a trust is an arrangement whereby one party (the Settlor) transfers legal ownership of assets to another party (the Trustee), who holds and manages those assets for the benefit of a third party (the Beneficiary) in accordance with the terms of a trust deed. A Protector may also be appointed to oversee the Trustee and safeguard the Beneficiaries' interests.
The Four Roles in a Family Trust
Settlor — Transfers legal ownership of assets to the Trustee for the benefit of the Beneficiaries
Trustee — Holds legal ownership of trust assets and manages them in accordance with the trust deed
Beneficiary — Appointed by the Settlor; holds beneficial ownership and receives distributions from the trust
Protector — Oversees the Trustee (e.g., power to replace the Trustee or approve certain decisions)
